The H-1B visa continues to offer the most common route to foreigners in specialty fields to legally live and work in America – and 2026 will see some of the most radical changes to the programme in years.

It is now a different ball game with a new wage based lottery system, a registration fee of 100,000 to the employer and a set of tougher specialty occupation requirements. However, to employees who have the right skills, the right plan and the right employer, it is still very possible to get US visa sponsorship.

What is the H-1B Visa?

H-1B is a non-immigrant visa, which allows the US employers to temporarily introduce foreigners into their workforce in the field of specialization (i.e., jobs that require at least a bachelors degree (or equivalent) in specialty). The visa is first awarded a period of three years and may be renewed to a total of six years. Mostly, H-1B employees are also able to apply a Green Card (permanent residency) using their employer on the visa.

Most importantly, you cannot make an application to an H-1B on your own. You have to be sponsored by a US employer, submit a petition to USCIS (US Citizenship and Immigration Services) and in most instances, enter you into the annual lottery.

The New Wage-Weighted Lottery (FY2027)

Beginning with the FY2027 cap season, where registration starts on 4 March 2026 and ends on 19 March 2026, the H-1B lottery is not randomly selected any longer. The USCIS currently employs a wage-based selection system, indicating that the registration based on higher paying jobs has greater chances to be selected.

This is a big strategic change. What it implies is that when you are negotiating a salary of a position that you want to use to be sponsored under the H-1B program, it will actually increase your likelihood of winning in the lottery case you want to be sponsored to a higher wage level. The most stable sponsors are the top tech companies:

Amazon

Google

Microsoft

Meta

Apple

Large consulting and IT services companies (Deloitte, Infosys, TCS, and Wipro)

Remember that the cap petitions of H-1Bs in FY2027 should have a start date of employment not before 1 October 2026.

Cap-Exempt Employers: An Effective Alternative

Not all H-1B opportunities require going through the lottery. H-1B workers can be sponsored by cap-exempt employers on an all-year-round basis, without a lottery and without a limit. These include:

Universities

Non-profit research organisations

Related medical institutions

Cap-exempt organisations are a strong targeting strategy to professionals in academia, research and healthcare. Assuming you are offered a position at a university or nonprofit research institute, your employer will be able to submit an H-1B petition at any point of the year and you can start work within a significantly shorter period of time compared to the usual lottery system.

Cap-exempt sponsorship is particularly worth considering in the case of the STEM OPT graduates who wish to have additional time to consider their opportunities before participating in the main H-1B lottery cycle.

The Leading Industries and Employers Sponsoring H-1B Visas

H-1B sponsorship is dominated by technology. The most frequent are:

Software engineers

Data scientists

Machine learning engineers

Systems analysts

In addition to the big tech giants, thousands of smaller and startup businesses also fund H-1B visas. Another good sector is healthcare. Physicians, surgeons and specialised nurses may be qualified but healthcare positions usually demand extra licensing and state certification procedures on top of the visa itself.

Analysts, actuaries, financial engineers and management consultants are regularly sponsored by finance and consulting institutions. Structural engineers, civil engineers, and urban planners are sponsored by architectural firms and engineering firms. Postsecondary teachers and researchers are sponsored even by education institutions.

The regular leaders in volume of H-1B sponsors on the USCIS H-1B Employer Data Hub are Amazon, Google, Microsoft, Meta, Apple, Deloitte, EY, Accenture, Cognizant, Infosys, TCS, and Wipro.

Find H-1B Sponsoring Employers

The best thing to do initially would be to research the history of an employer and H-1B. The H-1B filings databases that are publicly disclosed via US Department of Labor disclosures can be used to view the companies that sponsor H-1Bs, at what wages, and on what jobs.

In applying, you want to do jobs that are well aligned with your major.

“Analyst” or “coordinator” is a vague job title that is associated with increased H-1B denial rates.

Be precise and make sure that your degree is relevant to the job.

Begin early – preferably develop contacts with US employers six months prior to the registration window.

In the US, STEM OPT students have a better chance at this, since they are able to show on-the-job performance, before the employer makes a commitment to sponsorship.

Conclusion

The H-1B 2026 is more strategic than ever. Higher salaries are rewarded by a lottery that is weighted by its wage, cap-exempt employers provide an alternative, and tougher specialty occupation regulations imply that preparation is necessary. However, to professionals whose skills are in demand, have a great employment opportunity and the employer of choice, the H-1B is still a very tangible means of working, and at some point, gaining permanent residence in the United States.

The dream to work in the United States has always been of millions of skilled workers worldwide.
